Financial Provision on the Breakdown of a Civil Partnership

One of the most worrying aspects of the breakdown of any Civil Partnership is what will happen to the assets and debts accumulated both during and before the partnership was registered. Ancillary relief is the term used to describe this financial provision.

The Court is able to make orders relating to:

  • Income (Maintenance)
  • Capital (Lump Sum)
  • Property
  • Pensions

We are able to advise you as to the types of orders that the Court is likely to make in your case.

Not all financial matters need to be decided by the Court. Instead you could arrange a settlement either:

  • with your partner alone;
  • via a third party who could be a family friend or more formally at mediation; or
  • by solicitor negotiation.

Our team will record any agreement you reach in a Court order, put you in touch with local mediators or negotiate with solicitors acting for your partner.

We recognise that each breakdown is unique and we will tailor our advice to meet your needs.
