Children

The rules relating to what circumstances children can apply to join their settled parent or guardian in the UK are complex, and in our experience, each case is unique.

However in all cases, children must be under 18 years of age, unmarried and not leading an independent life. Children can apply to the UK in the following circumstances:

  • to join or stay with parents settled in the UK
  • to join one parent in the UK
  • to stay with a person in the UK who is not their parent
  • for education purposes
  • to join or accompany parents in the UK with Limited Leave to Remain
  • to join their adoptive parent(s)

Parents can also apply to join their children who are resident in the UK under certain circumstances but again, the Immigration Rules are complex and not each case is the same.
