The Highly Skilled Migrant Programme was introduced an alternative scheme to those who are highly skilled and who want to work in the UK but, are not required to have a job offer.
The HSMP is in fact being replaced by Tier 1 (General) of the new Points Based system. Tier 1 (General) has been in force since 29th February 2008 and any initial applications made in the UK after 29th February 2008 by those who are able to switch their status from another immigration category, must apply under Tier 1 (General).
The qualifying criteria for the HSMP and Tier 1 (General) are similar but, there are some important changes and applicants should obtain advice before the making of an application under Tier 1 (General).
Applicants outside of the UK are still able to apply under the HSMP. The government has proposed that applicants from India will need to apply under Tier 1 (General) from 1st April 2008 and the rest of the world from June 2008.
There are transitional provisions in force for applicants who applied under the HSMP before certain key dates, and we can help you identify whether you will be able to enter or remain in the UK under the HSMP.
Under the HSMP and Tier 1 (General), applicants will need to score a minimum of 75 points in total for qualifications, previous earnings, age and UK experience. However, under Tier 1 (General) Applicants will also now need to score an additional 10 points for maintenance and 10 points for English Language.
Preparing an application for the HSMP or Tier 1 (General) may seem easy if you qualify but, the refusal rate for the HSMP is high. This is due to the fact that the points awarded are heavily determined by the documents that you produce and the rules as such are particularly rigid.
