Grandparents’ applications

Although grandparents do not have an automatic right to enjoy contact with their grandchildren, the Courts have come to recognise that grandparents are an essential part of a child's life and most children see their grandparents as important figures in their lives, who frequently have a stabilising influence.

A grandparent may make an application to the Court for contact with their grandchild by initially inviting the Court to grant them permission (leave) to make such an application.

It is very rare that the Court would refuse a grandparent contact unless there is evidence of abuse or violence. However, it is essential that applicant’s receive good legal advice as they will need to persuade the Court that they have a meaningful and ongoing relationship with the grandchild which significantly benefits their lives.
