Enforcement and variation of Court Orders

If a partner breaks an undertaking or an order, we are experienced in advising on the enforcement of both domestic and foreign orders in the most advantageous and cost effective ways.

The Courts have a wide range of remedies, which include: attachment of earnings order, charging order, committal, execution of instrument, third party debt order, judgment summons, sequestration, bankruptcy and registration in the Magistrates Court.

It is sometimes necessary to enforce orders overseas, which we can assist you with.

Further, the Court has the power to vary or discharge certain Final Orders if necessary, for example, if there was a change in an individual’s circumstances or if a party has been dishonest during the previous proceedings.
